Terms of Service
Rules for using Burnner.
A) About Burnner / Acceptance
Burnner (“we”, “us”, “our”) is a social challenge platform that lets users create challenges with friends, set forfeits, and record outcomes. These Terms of Service (“Terms”) apply to your access to and use of the Burnner mobile app and our websites (burnner.com) (together, the “Service”).
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of a business or organisation, you confirm you have authority to bind that entity, and “you” includes that entity.
B) Eligibility
You must be at least 16 years old to use Burnner.
By using the Service, you confirm that:

you meet the minimum age requirement,

you can legally form a binding contract in your country of residence, and
-
you will comply with these Terms and all applicable laws.
C) Accounts
You must provide accurate and up-to-date information when creating an account. You are responsible for maintaining the confidentiality of your login details and for all activity under your account.
If you believe your account has been compromised, contact us at info@burnner.com as soon as possible.
We may suspend or disable accounts where we reasonably believe there has been unauthorised access, fraud, misuse, or a breach of these Terms.
D) User Conduct
You agree not to:

harass, threaten, bully, or impersonate others;

post illegal, hateful, or sexually explicit content;

use the Service to scam, defraud, or mislead;

attempt to hack, disrupt, scrape, reverse engineer, or overload the Service;

upload malware or misuse any automated tools/bots; or
-
use the Service in a way that could cause harm to yourself or others.

You agree not to use the feed or community or group features to harass, bully, threaten, defame, shame, or target other users. You must not post hateful, sexually explicit, illegal, or dangerous content, or encourage self-harm or unsafe behaviour. We may remove content and restrict accounts for violations.

E) Bets / Challenges
Burnner is a social challenge platform. Burnner is not a gambling service. Burnner does not take custody of money, does not process wagers, and does not facilitate cash betting between users.
Challenges, group bets, community bets, and leagues (where available) are social features. Users are responsible for choosing appropriate stakes/forfeits and participating safely and lawfully.
Forfeits and deadlines
Some challenges include a deadline to complete a forfeit. If a forfeit is not marked as completed within the allotted time, Burnner may display a status on the feed indicating the forfeit was not completed on time (“Not Completed” status). When the forfeit is later marked as completed, the status may update or be removed.
You acknowledge that this “Not Completed” status is part of the Service’s competitive/social experience and is based on the information available in-app (including user actions and any enabled verification signals). Burnner does not guarantee that all statuses are error-free.
Prohibited forfeits and content
You agree that you will not create, request, or pressure others into forfeits that are dangerous, illegal, hateful, abusive, humiliating, sexually explicit, or discriminatory. We may remove challenges/forfeits and restrict accounts where we believe a forfeit or related content is unsafe or violates these Terms.
Responsibility
You are solely responsible for your participation in any challenge, community bet, group bet, or league, including your actions and any consequences. Burnner provides tools to create and track challenges but does not guarantee outcomes or enforce private agreements between users.
F) Content & Trademarks
The Burnner name, logos, and branding are owned by Burnner and may not be used without our written permission.
You may be able to submit content to the Service (such as challenge titles, messages, images, or results) (“User Content”). You retain ownership of your User Content, but you grant Burnner a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute your User Content solely for operating, improving, and providing the Service.
You represent that you have the rights to post your User Content and that it does not infringe anyone else’s rights.
G) Disclaimers
To the maximum extent permitted by law, Burnner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities arising out of or related to your use of the Service.
We do not guarantee the accuracy of user-reported results, timestamps, or status updates on the feed. Automated status messages (including “Not Completed”) may be generated based on system rules and user actions and may not reflect real-world circumstances.
Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
H) Limitation of Liability
To the maximum extent permitted by law, Burnner (including its owners, officers, employees and partners) will not be liable for any loss or damage arising out of or in connection with your participation in challenges, forfeits, events, meetups, or any physical activity linked to the Service, including injury, illness or death, except where such liability cannot be excluded under applicable law.
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability which cannot be excluded or limited by law.
I) Termination
You may stop using the Service at any time.
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, created risk/harm to others, or misused the Service.
Where required by law, we will provide notice and/or an opportunity to address the issue where reasonably possible.
J) Changes to Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, by posting an updated version on our website or in-app).
Your continued use of the Service after changes become effective means you accept the updated Terms.
K) Safety / Medical Disclaimer
Burnner is not a medical service and does not provide medical advice. Any fitness or physical challenges are voluntary and may involve risk. Consult a qualified professional before beginning any new exercise activity, and stop immediately if you feel unwell.
You are responsible for ensuring any challenge you participate in is safe, appropriate for your ability, and permitted where you live. Burnner
L) Purchases / Merch / Shipping / Returns
If you purchase merchandise through our online store, you agree to provide accurate purchase and delivery information. Prices, taxes, shipping, and delivery estimates will be shown at checkout.
All sales are subject to our returns and refund rules shown at checkout or on our Returns/Refunds page (if you have one). Nothing in these Terms affects your statutory consumer rights.
We may refuse or cancel orders where we reasonably suspect fraud, unauthorised payment use, or misuse of promotions.
M) Third-Party Services
The Service may integrate with third-party services (for example Strava) or link to third-party websites. Those third parties operate under their own terms and privacy policies. We are not responsible for third-party services, availability, or their actions.
N) Feed and community visibility
Burnner includes a feed and community features that may display activity such as challenge creation, participation, status updates, and completion outcomes (including “Not Completed” statuses where applicable).
You control certain actions (for example, marking a forfeit as completed), but you understand that some outcomes and statuses are designed to be visible to others as part of the competitive experience. You should only participate if you are comfortable with this type of visibility.
We may moderate, remove, or restrict access to feed/community features to keep the platform safe and fair.
O) Leagues, group bets, and community bets
Leagues, group bets, and community bets are features intended for friendly competition. You agree to use these features in good faith and not manipulate results, spam, or coordinate harassment. We may void, remove, or limit participation in leagues or groups if we reasonably suspect abuse or rule-breaking.
P) Moderation and removal
We may remove content, hide posts, edit formatting, limit distribution, or disable features if we believe content or behaviour violates these Terms or creates risk to users or the community. We are not obligated to display any content and may take action without prior notice where necessary for safety or compliance.
Q) Health, Fitness & Safety Disclaimer
Burnner includes fitness-related challenges and user-selected forfeits. Burnner provides a social platform for challenges and tracking only and is not a medical, health, or safety service.
You are responsible for choosing challenges/forfeits that are appropriate for your fitness level and circumstances. Do not attempt any activity that is unsafe, illegal, or beyond your ability. You should consult a qualified professional before starting any new exercise program, especially if you have any medical condition, injury, or are pregnant.
If you feel unwell, dizzy, short of breath, or experience pain, stop immediately and seek medical advice. In an emergency, call local emergency services.
R) Assumption of Risk
You understand and agree that participation in physical activity involves inherent risks, including property damage, serious injury, illness, disability, or death. You voluntarily assume all risks arising from or related to your participation in challenges, forfeits, events, or any activities connected to Burnner, whether occurring online or in the real world.
You are responsible for assessing your own fitness and safety and for choosing whether to participate, and you participate entirely at your own risk.
R) No supervision / No responsibility for user conduct
Burnner does not supervise, control, or guarantee user behaviour or real-world activities. Users interact at their own risk. You are responsible for your own actions and for evaluating any challenge/forfeit before participating.
